Bank account में ₹15 लाख था — पूरा tax + advance tax adjustments में चला गया। Dreams of bike, iPhone, vacation सब cancelled। यही Section 115BBH का reality है।

Section 115BBH — 30% Flat Tax

The rule: Any gain on transfer of VDA taxable at 30% + cess + applicable surcharge

What makes this draconian:

  1. No indexation — holding period chahe 5 yr ho, 5 din ho, same 30%
  2. No 80C / 80D / HRA deduction against VDA income (separate head)
  3. Cost of acquisition only deductible — gas fees / exchange fees / platform charges NOT allowed
  4. Loss from VDA cannot be set off against ANY other income (salary, business, other capital gains — all barred)
  5. Loss carry-forward not allowed — if you lost in VDA, गया सो गया। Year-end mein set karna allowed ki nahi — ambiguous

The loss set-off debate (ongoing 2024-26)

Section 115BBH(2)(b): "Loss from transfer of VDA shall not be allowed to be set off against income computed under any provision..."

Interpretation 1 (strict / CBDT leaning):

  • Each coin's P&L standalone
  • Profits taxed at 30%, losses simply disregarded
  • Bitcoin पर ₹5 L gain + Dogecoin पर ₹3 L loss = tax on ₹5 L full (not ₹2 L net)

Interpretation 2 (industry lobby):

  • Within VDA basket, net the P&L
  • Net ₹2 L = taxed at 30%
  • More reasonable economically

Reality check: CBDT ने formal circular नहीं निकाला है Apr 2026 तक। Most CAs conservative route (Interpretation 1) अपनाते हैं। Few ITAT rulings industry side leaning, but not binding nationally। Editor verify latest CBDT circular।

Section 194S — 1% TDS

The rule: जब भी VDA transfer होता है (sale/swap), buyer ne seller को 1% TDS deduct करना है।

Specified Persons (SP)

  • Individual/HUF: Threshold ₹50,000 per year (agar business turnover <₹1 Cr pichhle FY)
  • Others: Threshold ₹10,000 per year
  • यानी ₹50K से कम trades तो TDS नहीं।

How exchanges handle

Indian exchanges (WazirX, CoinDCX, Giottus, Mudrex):

  • Exchange automatically deducts 1% on sale value (not gain — value!)
  • Issues Form 16E / Form 26QE quarterly
  • Deposits to Indian govt
  • Shows up in your Form 26AS

P2P / peer-to-peer:

  • Buyer के पास TDS compliance burden
  • Form 26QE file करना buyer को (within 30 days of transaction)
  • Non-compliance → interest + penalty

1% on sale value impact

Agar tumne ₹10 L का Bitcoin बेचा:

  • 1% = ₹10,000 TDS deducted
  • Even if you made zero profit (bought & sold at ₹10 L), ₹10K TDS
  • Refundable via ITR if your overall liability < TDS

6. Stablecoin Swaps (USDT ↔ USDC)
